محمد بن راشد يصدر مرسومين بشأن “دبي للاستثمارات الحكومية”و”محمد بن راشد للإسكان”

 

أصدر صاحب السمو الشيخ محمد بن راشد آل مكتوم نائب رئيس الدولة رئيس مجلس الوزراء، بصفته حاكما لإمارة دبي المرسوم رقم / 17 / لسنة 2012 بتشكيل مجلس إدارة ” مؤسسة دبي للاستثمارات الحكومية ” برئاسة سموه.

ونص المرسوم على أن المجلس يضم في عضويته كلا من، سمو الشيخ حمدان بن محمد بن راشد آل مكتوم ولي عهد دبي، نائبا للرئيس وسمو الشيخ مكتوم بن محمد بن راشد آل مكتوم نائب حاكم دبي و سمو الشيخ أحمد بن سعيد آل مكتوم رئيس هيئة الطيران المدني في دبي و معالي محمد إبراهيم الشيباني مدير عام ديوان صاحب السمو حاكم دبي إضافة إلى عمله كرئيس تنفيذي للمؤسسة.

كما نص المرسوم في مادته الثالثة على أن تعتبر القرارات الصادرة كافة عن مجلس الإدارة المعين بالمرسوم رقم / 50 / لسنة 2009 اعتبارا من الثالث من شهر مايو 2012 وحتى تاريخ العمل بهذا المرسوم.أنها تمت بصورة قانونية على أن يعمل بهذا المرسوم اعتبارا من تاريخ صدوره و ينشر في الجريدة الرسمية.

كما أصدر صاحب السمو الشيخ محمد بن راشد آل مكتوم بصفته حاكما لإمارة دبي مرسوما رقم / 18 / لسنة 2012 بتشكيل مجلس إدارة ” مؤسسة محمد بن راشد للإسكان ” برئاسة محمد إبراهيم الشيباني.

ويضم المجلس في عضويته كلا من، حسين ناصر لوتاه نائبا للرئيس وسلطان بطي بن مجرن و عبدالله أحمد الحباي و عبدالله فاضل المزروعي و عبيد سعيد بن مسحار و سامي عبدالله قرقاش، ويعمل بهذا المرسوم اعتبارا من تاريخ صدوره و ينشر في الجريدة الرسمية.

وأصدر صاحب السمو الشيخ محمد بن راشد آل مكتوم نائب رئيس الدولة رئيس مجلس الوزراء بصفته حاكما لإمارة دبي قانونا رقم / 9 / لسنة 2012 بتعديل بعض أحكام القانون رقم / 8 / لسنة 1997 بشأن تنظيم غرفة تجارة وصناعة دبي.

وحددت المادة / 6 / من القانون الجديد التي ستحل محل المادة ذاتها في القانون رقم / 8 / لسنة 1997 ، مهام وصلاحيات الغرفة بما يمكنها من تحقيق أهدافها حيث منحت الغرفة صلاحيات تسجيل الأشخاص الطبيعيين والاعتبارين المرخص لهم بمزاولة الأنشطة المنصوص عليها في المادة / 7 / من القانون في عضوية الغرفة وتزويدهم بالشهادات والوثائق التي تساعدهم على إنجاز معاملاتهم التجارية وممارسة أنشطتهم.

ويكون للغرفة إصدار شهادات المنشأ على اختلاف أنواعها للبضائع المصدرة أو المعاد تصديرها والمصادقة على التواقيع والأختام وكذلك على الأوراق والشهادات والعقود وغيرها من المستندات المتعلقة بالمعاملات التجارية للأعضاء.إضافة إلى إبداء الرأي في التشريعات المُنظمة للشؤون التجارية والاقتصادية المختلفة.ودراسة مشاريع القوانين والنظم واللوائح التي تضعها الجهات المختصة لتنظيم تلك الشؤون، وتشكيل مجموعات عمل من أعضاء الغرفة من ذوي الأنشطة المتماثلة أو المتجانسة وفقا للائحة التي يعتمدها المجلس في هذا الشأن.

ويمنح القانون أيضا غرفة تجارة وصناعة دبي صلاحيات ترخيص مجالس الأعمال التي يتم تشكيلها في الإمارة من الشركات وأصحاب الأعمال والخبراء المنتمين إلى جنسية معينة ومنحها الشخصية الاعتبارية بالتنسيق مع الجهات الحكومية المعنية. بجانب دراسة الطلبات المقدمة من الهيئات والاتحادات والجمعيات والمنظمات الإقليمية والدولية غير الحكومية المتخصصة في المجالات التجارية والاقتصادية والمهنية لفتح فروع ومكاتب لها في دبي .ومن ثم ترخيصها ومنحها الشخصية الاعتبارية بالتنسيق مع الجهات الحكومية المعنية بما في ذلك دائرة التنمية الاقتصادية.

وتضطلع الغرفة وفقا للقانون باقتراح البرامج والخطط الاقتصادية والمشروعات الاستثمارية التي من شأنها تدعيم مكانة اقتصاد الإمارة وتقويته أو زيادة فرص العمل والاستثمار..إضافة إلى اقتراح التشريعات لتنظيم الشؤون التجارية والاقتصادية..علاوة على أنشطة الترويج وتوطيد العلاقات الاقتصادية للإمارة.

ونص القانون على أن اختصاصات غرفة تجارة وصناعة دبي تشمل أيضا إعداد الدراسات والبحوث والتقارير الاقتصادية التي تعنى بتقييم أداء القطاعات الاقتصادية وتطويرها وتشخيص المشاكل والصعوبات التي تواجهها.إضافة إلى دراسة طلبات تنظيم المعارض والمؤتمرات والندوات وحلقات البحث ذات الصلة بالجوانب الاقتصادية والتجارية التي تنظم أو تقام في دبي وإصدار التوصيات المناسبة في شأن الموافقة على تنظيمها.

كما تتولى الغرفة جمع المعلومات والبيانات المتعلقة بالجوانب الاقتصادية كأسعار السلع والمواد المتداولة والخدمات والأوراق المالية وإصدار بيانات بها.وكذلك جمع الإحصاءات الدورية والنصوص التشريعية والتنظيمية وتبويبها ونشرها عوضا عن تقديم النصح والمشورة إلى أعضاء الغرفة في المسائل القانونية أو التجارية أو الاقتصادية والفنية والإسهام في تطوير الكوادر الإدارية والفنية في مجالات الاقتصاد وإدارة الأعمال والعمل على إيجاد الإمكانيات والوسائل الضرورية لذلك ولها في سبيل ذلك إنشاء الكليات الجامعية والمعاهد ومراكز التدريب التجاري والفني.

وتقوم غرفة تجارة وصناعة دبي كذلك بدراسة الشكاوى التجارية وتوفير آلية لحسم المنازعات التجارية عن طريق الإشراف على عملية التحكيم وفقا لقواعد التحكيم المعمول بها في هذا الشأن..إلى جانب المشاركة في اللجان التي تشكلها الوزارات والدوائر والهيئات والمؤسسات الأخرى لدراسة المسائل المتعلقة بالشؤون الاقتصادية أو التجارية المختلفة.
